Municipal Council

Municipal Council is the highest decision making body within the institution chaired by the Speaker.  In terms of Chapter 3 of the Local Government Municipal Structures Act (Act no. 117, 1998) Municipalities must have municipal councils which  must meet at least quarterly. It should consists of a number of councillors determined by the MEC for local government in the province concerned by notice in the Provincial Gazette. The municipality has the power to designate councillors determined by the MEC for local government as full-time, An MEC’S determination must be in accordance with a policy framework as maybe determined by the Minister after consulting the MECS for local government.

 

The Municipal  objectives

A municipal council must strive within its capacity to achieve the objectives set out in section 152 of the Constitution and annually review:

  • the needs of the community;
  • its priorities to meet those needs;
  • its processes for involving the community;
  • its organisational and delivery mechanisms for meeting the needs of the community; and
  • its overall performance in achieving the objectives referred to in subsection (1).

The municipal council must develop mechanisms to consult the community and community organisations in performing its functions and exercising its powers.

 

Powers and functions of the municipality in terms of the constitution of South Africa are.-

  • A municipality has executive
  • the local government matters listed in Part B of Schedule 4 and Part B of
  • any other matter assigned to it by national or provincial legislation. authority in respect of, and has the right to administer- Schedule 5; and
  • A municipality may make and administer by-laws for the effective administration of the matters which it has the right to administer.
  • Subject to section 151 (4), a by-law that conflicts with national or provincial legislation is invalid. If there is a conflict between a by-law and national or provincial legislation that is inoperative because of a conflict referred to in section 149, the by-law must be regarded as valid for as long as that legislation is inoperative.
  • The national government and provincial governments must assign to a municipality, by agreement and subject to any conditions, the administration of a matter listed in Part A of Schedule 4 or Part A of Schedule 5 which necessarily relates to local government, if that matter would most effectively be administered locally; and the municipality has the capacity to administer it.
  • A municipality has the right to exercise any power concerning a matter reasonably necessary for, or incidental to, the effective performance of its functions.

Terms of Municipal Councils

The term of a Municipal Council may be no more than five years, as determined by national legislation. If a Municipal Council is dissolved in terms of national legislation, or when its term expires, an election must he held within 90 days of the date that Council was dissolved or its term expired. The Municipal Council, other than a Council that has been dissolved following an intervention in terms of section 119, remains competent to function from the time it is dissolved or its term expires, until the newly elected Council has been declared elected.
